Fire Safety Responsibilities

Under the Regulatory Reform (Fire Safety) Order 2005, the Responsible Person must ensure a suitable and sufficient fire risk assessment is carried out and kept up to date for relevant premises in England and Wales.

The assessment must be reviewed regularly and whenever there are significant changes to the building, its use, occupancy or fire safety arrangements.

A written record of the assessment and fire safety arrangements must be kept.

Frequently Asked Questions

Do blocks of flats need a fire risk assessment?

Yes. In England and Wales, buildings containing two or more flats require a fire risk assessment for the areas covered by fire safety law. This includes communal areas, the building’s structure, external walls and flat entrance doors that open onto communal areas. A standard communal assessment does not normally inspect inside every private flat.

Does an HMO need a fire risk assessment?

Most HMOs need a suitable fire risk assessment, but the exact scope depends on how the property is occupied and managed. Shared houses and bedsit-style HMOs can have different requirements. Housing law, HMO licensing conditions and fire safety law may all apply, so provide your property layout and licence details when booking.

Who is responsible: the landlord, managing agent or tenant?

The Responsible Person is the person or organisation with control of the premises. This could be the landlord, employer, managing agent, occupier or commercial tenant. More than one Responsible Person may share the duties, in which case they must cooperate and exchange relevant fire safety information.

Can I carry out a fire risk assessment myself?

A Responsible Person may complete an assessment if they have enough knowledge and experience to do it properly. However, the assessment must be suitable and sufficient. Professional help is sensible for HMOs, blocks of flats and complex commercial premises. Appointing an assessor does not remove the Responsible Person’s legal duties.

Can one fire risk assessment cover several properties?

No single generic assessment should be used for different properties. Each building has its own layout, occupants, escape routes and fire safety measures, so it should have an individual report. Portfolio bookings can still be coordinated under one account, with separate findings and action plans for each property.

Can I use an existing assessment after buying or taking over a property?

An existing assessment may still be useful, but the new Responsible Person must check that it remains suitable and up to date. It should be reviewed when management, occupancy, layout or fire safety arrangements have changed. An outgoing Responsible Person must pass relevant fire safety information to the incoming Responsible Person.

Should an assessment follow PAS 79 or BS 9792?

PAS 79-1:2020 provides a recognised method for assessing non-housing premises, such as offices, shops and warehouses. Housing premises, including HMOs and blocks of flats, are now covered by BS 9792:2025. These standards support good practice, but the legal requirement is still for a suitable and sufficient assessment.

Is a fire risk assessment the same as an external wall assessment?

No. A general fire risk assessment considers the overall fire safety of the premises. A Fire Risk Appraisal of External Walls, known as an FRAEW, is a specialist assessment completed under PAS 9980 where external wall construction may present a risk. Tell the assessor about any cladding or external-wall concerns before booking.
